What is considered a "Wrongful Death"?
A death caused due to another party’s negligence. This can be anyone from a medical practitioner to a negligent driver in an auto accident. How can you measure the damages of the death of a family member?
Generally, you cannot recover for emotional losses due to the death of a loved one. The only recovery you can make is for the economic losses the family suffers as a result of the untimely death of a member of the family. This is not confined to a wage earner alone, however. If it can be proved that the deceased offered future potential as a contributor to the family’s income, this, too, is a measure of damages.
